Attorneys for Ramesh “Sunny” Balwani sought to distinguish the former Theranos executive from the company’s founder Elizabeth Holmes, who was convicted of conspiracy and wire fraud charges earlier this year, as prosecutors emphasized their partnership during opening statements of the criminal fraud trial against Balwani.

On Tuesday, prosecutors and defense counsel from Orrick, Herrington & Sutcliffe laid out their cases for a jury of six men, six women and five alternates in U.S. District Judge Edward Davila’s San Jose courtroom. Federal prosecutors indicted Balwani, Theranos’ former president and chief operating officer, alongside Holmes in June 2018 for allegedly misleading investors and patients about the accuracy and reliability of its blood-testing technology, financial state and partnerships.
