A Commonwealth Court panel has sent back to a prosecutor a private criminal complaint against Pittsburgh City Council and the city’s former mayor, which claimed official oppression when it passed a ban on certain firearms.

Judge Christine Fizzano Cannon said the Allegheny County District Attorney’s Office must reconsider the petition, reasoning that District Attorney Stephen A. Zappala Jr. improperly declined to give them due consideration.
