The Pennsylvania Superior Court has ruled that a psychiatric practice is not entitled to indemnity from its insurer over a lawsuit stemming from a therapist’s sexual abuse of two patients.

A three-judge panel consisting of Judges Jack Panella, Judith Olson and James Colins affirmed a Montgomery County court’s ruling that the abuse did not fit under the definition of “wrongful act” under Penn Psychiatric Center’s employment practices insurance policy with United States Liability Insurance Co.
