Defamation • Limited Purpose Public Figure • “Actual Malice”

Mallory v. S&S Publishers, PICS Case No. 17-0849 (E.D. Pa. May 9, 2017) Slomsky, J. (21 pages).

Defendants were entitled to summary judgment in plaintiff’s defamation action based on the portrayal of her relationship with a famous writer in a biography of the writer because one allegedly defamatory statement came from her own memoir and while the other statement was susceptible to a defamatory meaning, she failed to show any evidence of actual malice. Motion for summary judgment granted.
