Google might be able to claim a moral victory following the latest venue decision from the U.S. Court of Appeals for the Federal Circuit on Friday. But it’s still going to have to face trial against Personalized Media Communications LLC over video streaming patents next month in Marshall, Texas.

U.S. District Judge Rodney Gilstrap of the Eastern District of Texas had pointed to Google’s agreements with a company called Communications Test Design Inc., which warehouses, refurbishes, repairs and ships Google hardware products in Google packaging from its warehouse in Flower Mound, Texas. That agency relationship created a “regular and established place of business” for Google, which gave rise to venue in the Eastern District, Gilstrap ruled in July.
