The U.S. Court of Appeals for the Federal Circuit has put some teeth in TC Heartland.

In its first opinion interpreting the Supreme Court’s May patent venue decision, the court said defendants can be sued for infringement only where they maintain a fixed, physical presence. Federal Circuit Judge Alan Lourie’s opinion rejected a decision from the Eastern District of Texas that extended venue to companies that employ staff at home offices in the district.
