The Appellate Division affirmed an order denying attorney costs and fees to a plaintiff who alleged the trial judge erred in denying attorney fees under 42 U.S.C. §1983 despite acknowledging the pleadings did not “expressly” allege a violation of her civil rights.

Chelsea Anzures alleged, in Anzures v. Morris County Juvenile Detention Center, that while she was detained at the Morris County Juvenile Detention Center in November 2016, she was assaulted by two MCJDC officers. Anzures asserted claims for assault, battery, mental anguish, and negligence against MCJDC, Morris County Department of Human Services, Morris County Sheriff’s Office, and later amended her complaint to include David Chaparro, according to the opinion.
