ESTATE OF GERALD ZIPPER, Deceased (14/4624/B) — This is an application by the executors of the will of Sheila Zipper, the postdeceased wife of Gerald Zipper, for an extension of time pursuant to EPTL 2-1.11(c) (2) to renounce her interest as surviving tenant by the entirety of a condominium apartment located at 215 West 90th Street in New York County.

Petitioners have established that the failure of Sheila Zipper to renounce her interest within nine months of the death of her husband was due to grief and depression that were so extreme as to make it impossible for her to manage her financial affairs, and from which she never recovered. The court finds that these circumstances constitute “reasonable cause” within the meaning of the statute and, accordingly, the application for an extension of time is granted (see Matter of Sittler, NYLJ, July 24, 2008, at 38, col 5 [Sur Ct, Suffolk County]). Reasonable cause having been shown, petitioners are granted leave to file a renunciation within 30 days of the entry of this decision.
