The Constitution’s bar on insurrectionists holding office does not apply to presidents, former President Donald Trump told the U.S. Supreme Court Thursday as the justices prepare to settle the question of his eligibility for returning to the White House.

The high court has agreed to review a Colorado Supreme Court decision that the Republican front-runner is disqualified from serving as president under Section 3 of the Fourteenth Amendment for having “engaged in insurrection” over his role in the Jan. 6, 2021, U.S. Capitol riot. That ruling has been stayed pending the outcome of Trump’s appeal, which the justices have placed on an expedited schedule.
