Citing data showing the frequency of emergency abortions, a group of Democratic attorneys general submitted an amicus brief Tuesday arguing against Texas’ effort to hurdle federal emergency abortion guidance.

“Examples abound of patients suffering grave harm when they do not receive necessary emergency care,” according to the brief, submitted in the U.S. District Court for the Northern District of Texas on behalf of attorneys general from 20 states and the District of Columbia. The brief follows an effort by Texas Attorney General Ken Paxton to challenge the recent guidance from the Department of Health and Human Services, under the Emergency Medical Treatment and Labor Act, EMTALA, which said hospitals must offer abortion in cases that would stabilize a patient’s health.
