SAN FRANCISCO — Calling it “a very close case,” U.S. District Judge Jon Tigar has declined to award “exceptional case” attorney fees against a Texas company that sued big players in the mobile phone industry.

The argument pursued by EON Corp. was “quite stretched, such that few patentees would pursue it,” Tigar wrote in an order filed Friday in EON Corp. IP Holdings v. Cisco Systems. “But the court cannot quite conclude that no reasonable patentee could see an opening in the court’s claim construction order through which the argument could be squeezed.”
