Jury sides with motorcyclist in rear-ender

On June 28, a jury awarded $6,800 to a motorcyclist who claimed that he sustained a hairline leg fracture when he was rear-ended. In 2008, Robert Post was struck by Billy Earnhart. Post claimed that he was stopped at a traffic light when Earnhart failed to keep a proper lookout or control his speed. Post claimed that he was unable to walk for approximately a week. He sought $10,000 for past pain and suffering. The defense disputed the damages, arguing Post’s injury was pre-existing and not serious enough to justify the size of the pain and suffering claim.
