On June 15, a driver who claimed that he rear-ended a stalled van in the middle of a highway recovered $2,255. Last year, John L. Phillips was driving a car on I - 635 West in Dallas County when he struck Felix Escolero’s van. He claimed that the van was stopped in the middle lane without any hazard lights. Escolero claimed that he was going between 40 mph and 50 mph. According to defense counsel, Escolero doesn’t speak English and said the police officer didn’t ask him for an accident description, which the officer denied. The jury found Phillips 49 percent liable and Escolero 51 percent liable, which reduced the $4,422 award for minor injuries.
