Men injured in crash win less than sought

On Sept. 18, a jury awarded a total of $11,900 to a driver and passenger injured in a motor vehicle accident, an amount far less than the $800,000 the pair sought. In 2005, A.B. Mansfield’s minivan was rear-ended by a dump truck driven by Kimberly Morvant Russell in Vidor. Mansfield, who was driving, and passenger Clinton Joseph Findley claimed they sustained herniated lumbar and cervical disks. Findley also said he was knocked unconscious. In addition to blaming Russell, Mansfield and Findley also sued her employer, Trahan Trucking. Russell argued that Mansfield stopped so suddenly that she couldn’t avoid the crash, which she claimed occurred at only 4 mph. The defense also contended that the plaintiffs’ injuries were pre-existing. The jury found Russell 70 percent and Mansfield 30 percent negligent, and awarded the plaintiffs damages for their past medical bills only.
