The expansion of Philadelphia’s airport shed one legal impediment when the U.S. Court of Appeals for the Third Circuit on Friday tossed the claims made by Tinicum Township, which neighbors the airport.

Because none of its allegations, based largely on technical deficiencies in the analysis of the expansion plan noted by the Environmental Protection Agency, demonstrated that the Federal Aviation Administration had been arbitrary or capricious in the decisions it made to advance the plan in light of its study, a panel of three judges denied Tinicum’s petition for review.
