In January 2008, before the start of trial in Slusser v. Laputka Bayless Ecker and Cohn , defense attorney Jeffrey McCarron confronted Luzerne County President Judge Mark A. Ciavarella about his relationship with plaintiffs’ counsel, Robert J. Powell.

There had been “considerable publicity” regarding the two and McCarron wanted to know if there was anything “which would present an issue to the fairness of the trial in this case by my clients.”
