The Alabama homebuilder says Chinese-made drywall is to blame, but it’s not likely to get the company that made it to the courthouse anytime soon.

“Everybody’s sort of just sitting there, waiting for the foreign defendants to appear,” said Steven Nicholas, a partner at Cunningham Bounds in Mobile, Ala., who is representing The Mitchell Co. in its case against Knauf Plasterboard in the U.S. District Court for the Northern District of Florida. Nicholas said it could take more than six months just to serve the complaint to Knauf, which is based in Germany.
