A Massachusetts trial judge has indicated that he might ask an appeals court whether the state’s lawyer-conduct rules require prosecutors to seek judicial approval to subpoena attorney records from a third party such as a bank.

During a hearing Tuesday in Commonwealth v. Forlizzi, defense attorney Bernard Grossberg, assistant attorney general Peter Mullin and an American Civil Liberties Union of Massachusetts lawyer debated that question.
