The high court's decision in Exxon Shipping Co. v. Baker held that the fair upper limit ratio of punitive to compensatory damages in cases arising under maritime law is 1 to 1. Many wonder whether the case, which slashed the punitives owed by Exxon for the 1989 Exxon Valdez oil spill from $2.5 billion to $507.5 million, will affect more disproportionate punitives in nonmaritime cases. As a harbinger of shrinking punitives, Exxon encourages defendants, yet advocates of uncapped punitives were hardly undone.
