Physicians who treated plaintiffs litigating against manufacturers of a medical device may be retained as expert witnesses by the defense, a state appeals court says.
The court said the limited pool of physicians experienced with the device — the pelvic mesh — would hinder Johnson & Johnson and subsidiary Ethicon from engaging knowledgable experts if the aisle-crossing were not allowed.
