Ex-general counsel Howard Udell, debarred from working in the health care industry, is raising two key issues on his appeal to the U.S. Court of Appeals in the District of Columbia.

Udell, you’ll recall, and two other top executives at Purdue Frederick Company, Inc., were convicted in 2007 of a criminal misdemeanor as responsible corporate officers of a company that misbranded a prescription drug. The company falsely claimed the drug Oxycontin was less addictive than other painkillers.
