Rough Day for Brocade Backdating Defense

After his lawyers argued that ex-Brocade Communications CEO Gregory Reyes didn't know it was illegal to backdate stock options, June Weaver, a former HR administrator at Brocade, testified Wednesday that Reyes once told her "it's not illegal if you don't get caught" -- but that she couldn't remember the context of the conversation. Reyes' attorney, Richard Marmaro, had tried on Tuesday to block Weaver's testimony. After the statement -- with the jury outside the courtroom -- Marmaro moved for a mistrial.
