The Delaware Supreme Court, clarifying the rules regarding the preservation of electronic discovery, said that the Court of Chancery did not abuse its discretion when it held a defendant in contempt for spoliation of evidence inGenger v. TR Investors LLC.

The Chancery Court last year heard the dispute between Arie Genger and TR Investors, an organization managed by Florida investor Eddie Trump. The two sides both claimed they possessed the majority voting interest in Trans-Resources Inc., a fertilizer and chemical manufacturer.
