The Delaware Department of Justice has sued two opioid manufacturers in the Court of Chancery, seeking to hold Teva, AbbVie-owned Allergan and several of their affiliate and subsidiary entities liable for the surge in heroin and fentanyl use and resulting overdoses and deaths among Delawareans.

Attorney General Kathy Jennings’ complaint, filed Tuesday, alleges violations of the Consumer Fraud Act and Controlled Substances Act and brings public nuisance claims against both companies, which she claims should have known their marketing practices would lead to a spike in opioid abuse.
