In a unanimous opinion authored by Judge Trea Pipkin, the Georgia Court of Appeals shot down the DeKalb County School District’s move to dismiss a funding discrimination suit brought by seven DeKalb County charter schools represented by Robert Fortson and McGuireWoods attorneys Peter Farley and Heidi Siegmund, who appealed the order.

“While we are disappointed in the outcome, we appreciated the Court of Appeals’ attention to the difficult and complex issues presented by the case,” a representative from Hall Booth Smith speaking on behalf of the defendant-appellant counsel said. “We believe there are some important issues that merit the Supreme Court’s attention, and we have filed a notice with the Court of Appeals of the intention to petition for a writ of certiorari.
