A federal judge has sanctioned two prominent products liability defense attorneys representing 3M at the most recent bellwether trial over its combat earplugs for “willful violation of my orders” during closing arguments, according to a transcript of the proceedings.

U.S. District Judge M. Casey Rodgers, who is overseeing the massive multidistrict litigation over 3M’s earplugs in the Northern District of Florida, found that Dechert’s Kimberly Branscome and Jay Bhimani, both partners in Los Angeles, disobeyed her court orders when they showed jurors a slide depicting the results of a specific test of the earplug’s effectiveness, the transcript says.
