Finding the federal death penalty is "tantamount to foreseeable, state-sponsored murder of innocent human beings," U.S. District Judge Jed S. Rakoff in New York ruled Monday that the 1994 act is unconstitutional. In April, Rakoff indicated that barring persuasive arguments from prosecutors, the high rate of reversals and exonerations would incline him to such a ruling.
