The Court's late-night ruling on Dec. 12 handed the presidency to George W. Bush more directly than its 1974 Watergate decision ended the presidency of Richard Nixon. The fallout over politics mixing with the Court may prove embarrassing. The Rehnquist Court has been exposed to sharp criticism, the likes of which it had not felt even from past controversial decisions on abortion and racial justice.
