The U.S. Court of Appeals for the District of Columbia Circuit found the Army had removed a career appointee from her job-protected status without offering adequate due process, reversing a lower court judgment.

In a 2-1 decision handed down Friday by Judge Bradley N. Garcia and joined by Judge Douglas H. Ginsburg, the D.C. Circuit faulted the Department of the Army for disregarding Maria Esparraguera’s constitutional rights as a civil servant in the federal Senior Executive Service (SES) bureaucracy.
