The First Appellate District reversed a judgment and remanded. The court held that jury instructions in an employee’s action under state whistleblower-protection statutes prejudicially misstated and misapplied limitations on her claims that were based on federal law.

Pamela Mize-Kurzman worked as an administrator for the Marin Community College District (MCCD) under Frances White, the MCCD president, and Anita Martinez, Mize-Kurzman’s direct supervisor. Mize-Kurzman reported to White that Martinez was apparently illegally tampering with the MCCD hiring process. Mize-Kurzman also reported to both White and Martinez her belief that a MCCD scholarship program was unconstitutionally granting MCCD-funded scholarships to certain students.
