The Third District Court of Appeals has stripped the Texas Health and Human Services Commission of a policy that has been used to deny a Medicaid benefit to an entire class of individuals in nursing homes.

A Waxahachie attorney specializing in elder law took on HHSC over its pervasive use of an administrative policy that has been denying a home exemption to persons that purchase a home after they enter a nursing care facility.
