Harvey Weinstein’s judgment on sexual misconduct charges in the court of public opinion prevented him from receiving a fair trial in the actual justice system, the disgraced Hollywood mogul’s attorney told New York’s top appeals court on Wednesday.

“These cases must be decided on the law and not on opinion polls,” Arthur Aidala, a name partner in the Manhattan firm Aidala, Bertuna & Kamins, argued to the New York Court of Appeals on behalf of Weinstein, who is serving a 23-year prison sentence on his 2020 conviction of sex crimes in Manhattan Supreme Court.
