Employers should proactively manage and mitigate potential compliance and litigation risks by ensuring that they have accurate wage-and-hour policies and procedures in place that comply with federal and state labor regulations, and that they clearly communicate those policies and procedures to employees.

If your client does not have written policies defining a set work week for their employees, you may need to work with them to determine the correct answers. Keep in mind that federal law requires each employer to establish a fixed, seven-day "work week" for each employee or set of employees for overtime calculation purposes.

As of Wednesday morning, Law.com Radar surfaced at least six lawsuits filed in the past few days against several companies all alleging that the hack had resulted in overtime pay violations for hourly workers. The lawsuits include one against The Giant company, operator of Giant Food Stores, which was filed in the U.S. District Court for the Middle District of Pennsylvania.
