A jury in Los Angeles awarded $417 million to a California woman who was diagnosed with ovarian cancer in 2007. Jurors found 9-3 that Johnson & Johnson failed to warn that its baby powder could cause the deadly disease.
The state’s Court of Appeals ruled that the Battery Park City Authority is a government entity and didn’t have legal standing to challenge Jimmy Nolan’s Law, a 2009 state law that gave workers who toiled in the aftermath of the terrorist attacks on the World Trade Center towers on 9/11, an extra year to file claims against the authority.
While acknowledging the possible medical and financial benefits of a pill embedded with a sensor that can tell doctors if and when patients take their prescribed medication, health care and data privacy lawyers warned about consent and data security issues associated with the new technology.
