Too many patents outside the realm of financial products and services are being swept into covered business method review at the U.S. Patent and Trademark Office, the U.S. Court of Appeals for the Federal Circuit ruled Monday.

The decision breathed new life into nonpracticing entity Unwired Planet LLC’s patent infringement case against Google Inc. The Patent Trial and Appeal Board had invalidated Unwired Planet’s patent for providing location services over a wireless network. The PTAB ruled that the patent claimed ineligible subject matter under Section 101 of the Patent Act.
