The court of appeals affirmed a district court judgment in part and reversed in part. The court held that the Liability Risk Retention Act preempted an order of the Nevada Commissioner of Insurance that prohibited a risk retention group from writing “first dollar” liability policies in the state. The court held further that the Act did not confer a right to be free from state law that could be enforced under federal civil rights lawand, thus, the district court erred in awarding the risk retention group recovery of its attorneys’ fees under 42 U.S.C. § 1988.
