SAN FRANCISCO — Stringently applying recent Supreme Court habeas corpus precedents, the U.S. Court of Appeals for the Ninth Circuit reinstated a 33-year-old death judgment Thursday, ruling that a San Jose killer was not necessarily prejudiced by being forced to wear a visible shackle at trial.

Judge Barry Silverman wrote that the California Supreme Court did not act unreasonably when it summarily rejected Marvin Pete Walker’s ineffective assistance of counsel claim in 2004.
