The Second Appellate District reversed a judgment. The court held that an employers purported honest belief that an employee violated the employers policy with regard to medical leave was no defense to the employees claim that he was wrongfully terminated in violation of the Moore-Brown-Roberti Family Rights Act; this defense improperly shifted the burden of proof regarding reinstatement from the employer to the employee.
