The court of appeals affirmed a district court judgment. The court held that in amending the California Constitution to eliminate the previously guaranteed right of same-sex couples to marry, Proposition 8 violated the Fourteenth Amendment of the United States Constitution. The court held further that the Californians violated the Equal Protection Clause by using their initiative power to target a minority group and withdraw a right that it possessed without a legitimate reasons for doing so.
