SAN FRANCISCO — The Justice Department today filed an emergency order seeking to reinstate a stay of the injunction against the military’s “Don’t Ask, Don’t Tell” policy.
The Ninth Circuit U.S. Court of Appeals last week lifted the stay that had been in place for eight months following a district court judge’s global injunction on the policy that bans gays and lesbians from serving openly in the military. The court’s order, the Justice Department said, pre-empts the “orderly process” for repealing the act — a process that Congress established to end the policy, saying it imposed “significant immediate harms on the government.”
