C.A. 4th July 31, 2008 D050333 The Fourth Appellate District affirmed a judgment. The court held that the Medical Marijuana Program Act’s identification card provisions are not preempted by the federal Controlled Substances Act.

California’s Compassionate Use Act of 1996 (CUA) established an exemption from state law sanctions for medical users of marijuan. The Medical Marijuana Program Act (MMP) was adopted in 2003 to address issues not included in the CUA. Among other things, the MMP established a voluntary program for the issuance of identification cards to persons qualified to claim exemptions associated with marijuana use.
