Peet’s Coffee was hit with a consumer class action on Dec. 19 in California Superior Court for Los Angeles County over speech restrictions contained in the company’s online terms of use. The court action, brought by Singleton Schreiber and the Law Offices of Thomas Leary, claims that Peet’s unlawfully requires website visitors to agree they will not make statements that expose the company to liability, reputational harm or brand damage. The suit, part of a string of similar cases, contends that the restriction violates California Civil Code section 1670.8. Counsel have not yet appeared for the defendant. The case is 23STCV30967 , Arterberry v. Peets Coffee, Inc.
