Employment non-competition provisions, also known as covenants not to compete, or “non-competes,” are provisions in employment contracts that prohibit employees from working or starting a competing business after leaving their current employer. These restrictions exist in many forms and while some are explicit (i.e., “thou shalt not work for a competitor”) others are disguised as overly broad confidentiality and non-solicitation clauses that act as non-competes.

This article will examine non-competes, in all their various forms, under the lens of some noteworthy economic research.
