The action was filed June 24 in California Central District Court by Fenwick & West on behalf of Yuga Labs Inc., the creator of the ‘Bored Ape Yacht Club’ (BAYC) non-fungible token (NFT) collection. The suit accuses the defendants of scamming Yuga Labs’ consumers into purchasing their NFTs by misusing Yuga Labs’ BAYC trademarks. The case, assigned to U.S. District Judge John F. Walter, is 2:22-cv-04355, Yuga Labs, Inc. v. Ripps et al.
