A California State Bar Court judge dismissed two disciplinary charges against a San Diego attorney who called a female judge’s legal fee ruling “succubustic,” but the court recommended disciplinary action for accusing the judge of intentionally refusing to follow the law and exhibiting bias.

In a ruling Thursday, the court recommended Benjamin Laurence Pavone of Pavone & Fonner be suspended for one year, with execution stayed, and placed on probation for one year, including a 30-day actual suspension for making false statements in appeal briefs about Orange County Superior Court Judge Carmen Luege. The court also determined a $2,500 monetary sanction was appropriate.
