A federal appeals court is weighing whether a legal challenge to some of Pennsylvania’s now-expired COVID-19 restrictions is moot, a question other courts have faced in similar pandemic-related litigation.

On Thursday, a panel for the U.S. court of Appeals for the Third Circuit questioned lawyers on whether a challenge to Gov. Tom Wolf’s emergency measures implemented last spring should be dismissed, given the orders expired in May. A key issue for the panel is whether the government will reissue the restrictions as the Delta variant of COVID-19 continues to spread.
