A divided Texas Supreme Court has ruled that products liability plaintiffs can’t sue Amazon.com Inc. if they’re injured by products they bought from a third-party seller on the retail platform.

In the 5-2 ruling in Amazon.com v. McMillan, with one justice not participating, the Supreme Court had to decide if Amazon counts as a “seller” under Texas’ common-law strict products liability law, when the website acts as a platform for merchants from all over the world to reach consumers.
