Class counsel in the $650 million biometric privacy settlement with Facebook have filed an emergency motion for a temporary restraining order that would halt what it calls a misleading advertisement from a competing plaintiffs firm soliciting class members to opt out of the agreement.

In a motion filed Friday, three firms serving as lead counsel in the case said Levi & Korsinsky has been posting a Facebook advertisement since Sept. 11 that says “Facial Recognition Compensation Claim.” The ad then sends class members to a website titled “Sign up for a Facebook Illegal Facial Recognition Claim.”
