The Pennsylvania Supreme Court has agreed to consider whether the Fifth Amendment privilege against self-incrimination protects a man from having to tell law enforcement officials a password to his encrypted computer that he had memorized.

The justices on Wednesday agreed to hear argument in Commonwealth v. Davis, on the single first-impression issue of whether the defendant, who is facing child pornography charges, can be “compelled to disclose orally the memorized password to a computer over his invocation of privilege under the Fifth Amendment.”
