A would-be class of 4,300 residents of Avoca, Pennsylvania, is suing Montgomery McCracken Walker & Rhoads, alleging they could have recovered over $619 million more in a toxic tort case that became intertwined with bankruptcy proceedings. But the firm says the plaintiffs already lost their chance to object to their award.

Montgomery McCracken was bankruptcy counsel to Avoca residents seeking to recover damages against the Kerr-McGee Corp. for injuries allegedly caused by proximity to the company’s wood treatment plant located in Avoca. The plaintiffs had been arbitrating the claims, but ultimately had to pursue the damages from Kerr-McGee, which was renamed Tronox, in bankruptcy.
